What is an EAD?

EAD stands for Employment Authorization Document. This legal document acts as a work permit and proves that you are eligible to work legally in the United States. The EAD is a physical card that includes your name, photograph, date of birth, Alien Registration Number, visa classification, and the expiration date of your work authorization.

If any of the following apply to you, you will likely need an EAD to ensure you are authorized to work in the country.

  • You are authorized to work in the United States based on your immigration status, and you need evidence of that fact
  • You are required to apply for permission to work because you have a pending Form I-485, Application to Register Permanent Residence or Adjust Status
  • You are required to apply for permission to work because you have a pending Form I-589, Application for Asylum and for Withholding of Removal

If you fall into any of these categories, you must file Form I-765, the Application for Employment Authorization.

How Can I Renew My EAD Work Permit?

An EAD card is valid anywhere from one to five years, depending on the category you fall into. Regardless, it is important that you understand how to renew your work permit. First of all, you should file to renew your EAD about 6 months before the expiration date to avoid any gaps between authorizations.

The process is identical to the original application process. To renew your permit, simply file a new application of Form I-765, the Application for Employment Authorization. Make sure you check your eligibility category and include the filing fee, if required. You can apply online or through the mail. You will be required to submit all supporting documents again. Make sure to include the following information, and that they are all up to date.

  • A copy of your most recent I-94 travel record
  • A copy of your current U.S. visa
  • A copy of your passport photo page
  • Two identical and recent passport-style photos of yourself
  • A copy of your last EAD card
  • Form G-28, if you are represented by an attorney or accredited representative
